  • Platform Access: The Platform is provided on an “as-is” basis. Carssist does not guarantee uninterrupted or error-free access. We reserve the right to modify or discontinue the Platform at any time.

1. Use of the App

Carssist provides a platform through the App that facilitates the connection between passengers and drivers. Carssist does not provide transport services directly. The transport services are provided by independent drivers. Carssist is not responsible for the fulfillment of any transport service contracts between you and the driver.

1.2 Contractual Relationship
When you use the App to request a ride, you enter into a contract directly with the driver for the provision of transport services. Carssist is not a party to this contract and does not guarantee the quality or availability of the transport services.

1.3 Payment
Payments for transport services may be made via the App or in cash, depending on the location and payment options available. Additional charges, such as booking fees, tolls, or surcharges, may apply. Tips can be given directly to the driver via the App, and we may set limits on tip amounts at our discretion.

1.4 Account Information
Your mobile number is linked to your Carssist account upon installation of the App. Notify Carssist within 7 days if you change your mobile number to ensure your data remains secure. Failure to notify us may result in unauthorized access to your account.

2. Promotional Codes

2.1 Usage and Expiration
Promotional codes may be sent to you from time to time and can be used towards payments for rides or other features. Promotional codes are subject to additional terms and have expiration dates, which will be reflected in the App.

2.2 Redemption
If your ride amount exceeds the promotional code value, the remaining balance will be charged to your payment method. Promotional codes are valid for one ride only and cannot be carried over.

2.3 Cancellation
Carssist reserves the right to cancel promotional codes at any time, including if they are used fraudulently or erroneously.

3. In-App Payment

3.1 Payment Methods
Payments through the App may be made using various methods including credit cards, mobile carrier billing, or other supported options. Carssist acts as a commercial agent for drivers, processing payments on their behalf.

3.2 Tips
You may choose to give a tip through the App. Carssist does not take a commission on tips and transfers them in full to the driver, subject to applicable taxes.

3.3 Additional Fees
Carssist is not responsible for third-party payment fees (e.g., bank fees). Review the terms of your payment provider for additional charges that may apply.

3.4 Payment Disputes

3.5 Upfront Fare
You may be offered a fixed fare for a ride (Upfront Fare). This fare may change if the route or duration of the ride changes significantly.

4. Ordering and Cancelling Services

Once a driver agrees to your ride request, the transport service is considered ordered.

4.2 Cancellation Fees
Cancelling a ride after the driver has confirmed may result in a cancellation fee. Repeated cancellations may lead to temporary or permanent suspension of your account.

4.3 No-Show Policy
If you do not arrive at the vehicle within the specified time after the driver’s arrival notification, the ride request will be canceled.

4.4 Damage to Vehicle
You may be charged a penalty of 50 EUR and additional compensation if you damage the driver’s vehicle. Carssist may pursue these claims on behalf of the driver if necessary.

5. License to Use the App

5.1 Grant of License
Carssist grants you a non-exclusive, revocable, and royalty-free license to use the App in accordance with these Terms and applicable app-store terms. This license is not transferable or sublicensable.

6. Liability

6.1 Service Quality
Carssist is not liable for the quality or defects in the transport services provided. The App is provided on an “as is” basis, and we do not guarantee uninterrupted or error-free access.

6.2 Limitation of Liability
Carssist, its affiliates, and employees are not liable for any loss or damage resulting from the use of the App or the transport services, including property damage, loss of profit, or business interruption.

You agree to indemnify Carssist and its affiliates against any claims or losses arising from your use of the App or the transport services.
